how investigators are treating the scene. >> yeah. this is now a crime scene. it is an active drunk driving investigation. a specialized team from with the chp is coming down to be here on the scene to do this investigation. right now, you can see that the slow lane here on northbound 680 just south of scott creek road is closed and it's expected to be closed for several hours. now, this accident happened at about 2:40 this morning. police say the driver of a silver nissan went off the road and on to the freeway's shoulder hitting two workers contracted with caltran. while they were out of their truck picking autopsy road construction sign. one one work died at the scene. the other was taken to the hospital with minor injuries. >> a multi disciplinary accident investigation team. it's standard procedure for them to investigate any state jobs. the company was contracted through caltran is and so it's

standard procedure for them to conduct the investigation, as well. >> the driver of the nissan had to be pulled from the wreckage by firefighters. he was taken to the hospital with life threatening injuries. chp sayses has stabilized. a field sobriety test was done on him and he failed it. officers determined alcohol was a factor because of that. this is now a crime scene. a much more thorough investigation has been done. the slow lane on 680 will be blocked off until it's completed and i'm told that officers are get ago blood draw from the driver of the nissan. that will help determine what his blood alcohol level was at the time of the crash. reporting live, matt keller, abc 7 news. >> matt, thank you. very tragic accident indeed. as we take you into milpedes northbound along 680, three miles of backup is what we've got. we were initially thinking that all lanes are going to reopen by 6:00. but now that it is an investigation, a criminal

and developing news this morning out of hayward. police are investigating the shooting of a woman at an apartment complex. it happened on sleepy hollow avenue. hayward police tell abc 7 news the woman was found around 11:00 last night. she had been shot several times and is undergoing surgery this morning. so far, they haven't released any information on a suspect or a motive. happening today, b.a.r.t.'s two largest union ves vote on theed contract deal thaended their strike. it gives workers a 15.4% raise over four years. workers would pay $129 a month for health coverage, higher than before. and are contributing to their pengs. b.a.r.t.'s board will vote during its regular meeting, november 21st, or at a special meeting before then. the union voting ends at 10:00 tonight. the state public utilities commission has approved new b.a.r.t. safety rules following the deaths of two workers. those new rules include threeway communications between central control, trains and workers.

new safety programs and standardized productive clothing. b.a.r.t. says it support the changes. new details on the sonoma county sheriff's deputy involved in the andy lopez shooting death. a man has come forward claiming he had an unsettling encounter with that same deputy recently. katie. >> his name is jeff westbrook and he apparently put two and two together and realized deputy eric galehouse aimed his gun at him two months ago. westbrook says he was driving his bmw when deputy galehouse pulled him over for a traffic stop. he claims during the stop, the deputy pulled out husband gun twice. westbrook thought it was uncalled for at the time, but now says it was scary knowing the same deputy pulled out a gun and killed a teenager. >> he just failed to use his blinker. and he just felt like, you know, it got to the point in his face

for something as minor as a blinker. galehouse's attorney gave us this statement regarding the incident, quote, based on deputy galehouse's experience and training, he would never willy-nilly pull out his gun, only if there would be a need for it. she also tells us that the shooting of lopez was the first time in his career lopez fired his gun in the line of duty. westbrook says he's going to talk to police about his encounter with the deputy. >> katie, thanks. 6:06 now. a stanford dormitory cafeteria is shut down for disinfecting and more than 50 students are being treated for a powerful illness. university officials quickly notified the santa clara health department when this happened on tuesday. four students had to be treated for dehydration. the symptoms point to one particular virus. >> the storms are very similar to noro virus.

these students experienced vomiting, diarrhea and nausea. >> it's caused by contaminated food or water, common on cruise ships, nursing homes and college dorms. it may take a week to find the stours of the infection. happening today, hospital workers are planning an informational picket line in front of five university of california medical centers this morning, includes ucsf. registered nurses, pharmacists, social workers and other professional employees are protesting uc's proposals with regard to staffing levels and pension reforms. the unions voted this week to authorize a strike. after months of bargaining for a new contract. also today, the man accused of murdering a bay area federal investigator returns to coast for an evidentiary hearing. randy alana tells our media partner that he wants a speedy trial. san ra coke's body was found in a park august 9th.

the coroner's report says she had been strangled. alana is coke's former boyfriend. he insists he didn't kill her, but doesn't deny being at the back of the motel where authorities think she was killed august 4th. alana was arrested two days later on parole violations. he has 17 felony convictions. the judge is allowing prosecutors to withhold the name of wpss for now. a sonoma county supervisor is back in court to answer a misdemeanor charge after a peeking incident outside a santa rosa woman's home. he was in his socks and underwear when he was arrested back in july on suspicion of prowling and burglary. s scheduled to be arraigned this morning. the 32-year-old has since apologized and described a long-term problem with bing drinking. 6:08. let's take a look at trofk now. problems persist on 680 in the south bay. here's layla. >> we're going to take you across 580 and see what's happening. things are quiet, but congestion

one construction worker is dead, another injured after the car crashed this morning on interstate 680. >> matt keller is live with new information he learned in the past half hour. matt. >> yeah, just a couple minutes ago, the chp let me know that the name of the company that these workers are contracted with caltran is named statewide traffic safety and signs, they are based in fairfield. now, there is a specialized

investigation team from the chp here on the scene. this is now a crime scene because officers have determined that drinking and driving was a factor in this crash. now, it happened at about 2:40 this morning. police say the driver of the silver nissan went off the road and on to the freeway shoulder hitting those two workers contracted with caltran while they were out of their truck picking up a road construction sign. one worker died at the scene. tory way tas taken to the hospital with minor injuries. the driver of the nissan had to be pulled from the wreckage by firefighters. he was taken to the hospital and currently has major injuries. officers say he failed a limited field sobriety test. >> at this point, it becomes a crime scene. and once it's determined that dui was a factor in the collision, then we will collect the evidence that we need and do what we need to do to make sure that we have everything we need for prosecution. >> officers say the driver of the nissan is under arrest and a blood test will be done to

determine his blood alcohol level. back out here live. as for the traffic here on northbound 680, you can see traffic is moving slowly here. one lane, the slow lane, is blocked off and it's expected to be blocked off for several hours as the chp continues its investigation into this fatal accident. reporting live in milpedes, matt keller. as you take a right into milpedes traveling northbound 680 at scott creek road, that's where you have that lane blocked. speed is picking up, 35 miles per hour. you might have been able to see those cars passing right by matt. traffic is start to go move. however, we were looking at backups coming away from calavares. take that over 2880. 880 will get you around these delays. a look at our drive time traffic, highway 4 from antioch to hercules, 4 11 minutes now. down to the maze, that is under 17 minutes, between 17 and 20

abandon on a car are in productive custody this morning. their father is due in court today being held in a santa clara county jail been 29-year-old lulo reyes is being charged with child endangerment. late tuesday night, the 29-year-old father drove two kids to north hill drive and left them in his suv while he visited a friend. the following afternoon, a concerned neighbor spotted the 8-year-old boy and 10-year-old girl and tauld 911. police say they arrested reyes when he reported the vehicle and children missing more than 24 hours after he left them. an east bay teenager is in the hospital this morning after suffering serious injuries in a high school football game last night. it happened at liberty high school in brentwood during a freshman football game. the school's principal tells abc 7 news the student's injuries were serious enough that he had to be air lifted to a hospital. he declined to give further details. new this morning about the

a man says the same sheriff deputy who shot and killed a teenager carrying a replica ak-47 pulled a gun on him. >> this man believes the use of the gun was unwarranted? >> yes. he says he was pulled over for a traffic violation and he was shocked and scared to find out if it was the same deputy to use lethal force. jeff westbrook says two months ago he was driving his bmw when deputy eric galehouse pulled him over for failing to use his turn signal. during the encounter, the deputy pulled out his gun twice. now his stepdaughter, speaking on his behalf, says he's compelled to come forward. >> he says he will talk to the police department and he will report that because it's just -- it shouldn't be happening. >> galehouse's attorney, terry le oi ni gave us this statement reporting the incident. base dollars on deputy galehouse's experience and trail training, he would never willy-nilly pull out his gun, only if there would be a need

america, is coming up at 7:00. a fresno area woman is suing mcdonald's after suffering burns from hot coffee that spilled in ler lap while she was going through the drive through. a jury award stella lyback nearly $3 billion for her burns 20 years ago. back then, mcdonald's kept its coffee between 108 and 190 degrees. franchises now keep their coffee about ten degrees cooler, but it's still as much as 30 degrees cooler than the coffee you make at home. 70-year-old joan fino wants to change that. >> i went in to get coffee and, you know, it's their fault. it was too hot and the lids weren't on right. >> her attorney admits she didn't suffer million dollar injuries, but they're suing for millions, anyway, claiming mcdonald's is still putting profits over people's safety. mcdonald's has not commented on the soup. >> when i buy a coffee, i have to stick it in the microwave or heat it up a little bit more.
